These General Terms and Conditions of Use and Sale are the terms and conditions applicable to the use of www.shoppinginibiza.com (hereinafter the “Website”), and the contracting of Products or Services (hereinafter “Products”) via the Website, and they substitute any other terms and conditions, unless previously agreed and recorded in writing between Shopping in Ibiza and the User. Consequently, the User who accesses the Website (hereinafter the “Client”) and/or contracts Products via the Website agrees to submit to and remain linked by the Terms and Conditions of Use and Sale as they appear when the User accesses the Website.

Shopping in Ibiza provides information about Products and Services, and it offers the possibility of their acquisition and contracting via the Website.

The photographs, graphic or iconographic representations, and videos related to the Products, in addition to commercial names, brands or distinctive signs of any kind contained on the Website aim to provide the Client with as much information as possible.

The descriptions of the Products offered on the Website are created based on the information and documentation provided by the suppliers and collaborators of Shopping in Ibiza.

Any Client who hopes to acquire or contract Products via the Website must be over 18 years old and have sufficient legal capacity to sign contracts.

Shopping in Ibiza operates, via the Website, on the Spanish Peninsula and the Balearic Islands and in Europe in:

Zone A Europe: Germany, Austria, Belgium, Denmark, Slovenia, Slovakia, France, Hungary, Italy, Luxembourg, NetherlandsPoland, Romania, and Czech Republic.


Zone B Europe: Bulgaria, Estonia, Finland, Greece, Ireland, Latvia, Lithuania and Sweden (hereinafter, in "Territory" ). It undertakes deliveries and distributes Products exclusively in the Territory.

By accepting these Terms and Conditions of Use and Sale, the Client accepts that their details will form a part of the file “clients and/or suppliers” of Shopping in Ibiza S.L., and the handling of these files will be undertaken in compliance with the points established in the Privacy Policy.

Due to logistic reasons of the country in case of withdrawal, the client will have to send us the merchandise by his own means to the attention of SHOPPING IN IBIZA, S.L. C/ del Vidrier, local 48. 07819, Jesus, Ibiza (Spain). Once the shipment has arrived at our facilities, we’ll proceed to the refund of the purchase’s amount, including the delivery costs incurred by the costumer, using the same payment method used by the costumer for the initial transaction.

PURCHASES AND PAYMENT METHODS

Buying is very simple

You only have to choose the Product, place it in the 'Cart' and follow the steps that we will indicate on the Web Site.

The prices of the Products or Services offered through the Website include VAT and any other applicable taxes. They do not include the costs of preparation and shipping, and transportation costs of the Products, which are detailed in the payment process and must be accepted at the time of order confirmation.

In the Products that are on sale with a discounted price will appear, next to the final price, the original price of the Product crossed out.

If once the order is completed you notice that it contains an error, please contact us immediately through info@shoppinginibiza.com to try to solve it before its preparation and shipment, and thus avoid charges for cancellation or return.

Shopping in Ibiza reserves the right to modify the characteristics and prices of the Products at any time. The Products will be invoiced at the price in force at the time of registration of the order.

In the event that, due to circumstances of force majeure or any incident attributable to Shopping in Ibiza, the Product is not available after the purchase has been made, we will inform you by email and we will offer you a similar product or proceed to the total or partial cancellation of the order. In case of total cancellation, the total amount of the order will be refunded and in case of partial cancellation, only the price of the unavailable Products will be refunded. In the event of non-delivery of a Product in orders composed of sets of Products or complementary Products, the customer may return the remaining products delivered, free of charge.

The sale of any Product or Service (for example: underwear, food products, show tickets, etc.) may be subject, in addition to these Conditions of Use and Sale, to special conditions of sale.

CONSUMER GOODS WARRANTY

In the event of any lack of conformity at the time of delivery of the good, Shopping In Ibiza will respond to the consumer for the faults that are manifested during a period of 3 years from the delivery, which will be understood to have been made on the day that appears on the purchase invoice. , or the delivery note if this were later.

Unless there is proof to the contrary, it will be presumed that the lack of conformity that manifests itself in the two years following the delivery of the good already existed when it was delivered.

Through a simple declaration, the consumer may demand that Shopping In Ibiza rectify the lack of conformity, reduce the price or terminate the contract.

Unless the good is brought into compliance, the consumer may opt for repair or replacement, unless one of these two options is impossible or involves disproportionate costs for Shopping In Ibiza.

The measures taken in case of repair or replacement of the good, will be free for the consumer, including the expenses that are necessary for the goods to be brought into conformity, especially the costs of shipping, transportation, labor or materials. They will be carried out within a reasonable time from the moment that Shopping In Ibiza has been informed of the lack of conformity.

The consumer will make the good available to Shopping In Ibiza, who will recover it at his expense in the way that generates the least inconvenience for the consumer, depending on the type of good.

Shopping In Ibiza, will provide the consumer with documentary justification on the delivery of the good by the consumer stating the date of delivery and the lack of conformity, as well as documentary justification of the delivery of the good already in accordance with the consumer, in which also The date of that delivery and a description of the corrective measure carried out must be stated.

The consumer may also choose the price reduction or termination of the contract.   • The consumer will not be responsible for any payment for the normal use of the replaced goods during the period prior to their replacement.
  • Whether the consumer request the correction of the lack of conformity, such as the reduction of the price or the termination of the contract, the consumer may demand compensation for damages, if applicable.

RETURNING ORDERS

DELIVERY OF ORDERS

You can receive your order at the address you indicate, or collect it in la Sirena and Art shopping centres: you may choose which when you place your order.

Your order will be sent to you via courier service within 5 working days for deliveries to Spain and Portugal and within 8-10 working days for the rest of Europe, excluding Saturdays, Sundays and public holidays in the places where the order is sent from or received. Shopping in Ibiza will not be responsible for any delays due to reasons beyond the control of the company or due to force majeure.

Shopping in Ibiza will send the Client an email informing them that the order has been dispatched from its warehouses and the contact details for the transportation company undertaking the delivery.

Shopping in Ibiza must deliver the Product in perfect condition to the address indicated by the Client, which must be within the Territory. In order to optimise the delivery process, delivery at the indicated address must be undertaken within normal working hours.

The Client will receive another email when the Product has been delivered to the indicated address or when it is ready to be collected at the chosen location.

The courier will try to deliver the Product at the address provided by the client when formalizing the order twice. If, when delivery is attempted, the Client is absent, the courier will leave a note so the Client can collect the Product at their office. If 10 calendar days pass from the date notice is given and the Client has not collected the order, the Product will be returned to the warehouses of Shopping in Ibiza and the Client will be responsible for the shipping and return costs in addition to possible associated handling fees.

When the order is delivered, the Client must show their identification documentation to the courier, sign the delivery note and request a copy of this from the courier.

The return of the shipment will not be accepted if the incidence is notified after the deadline.

For collection of deliveries at the Sirena or Art shopping centres, the Product will be available for collection by the Client for 10 calendar days from the date indicated in the notice email. Once this period has passed, the order will be returned to Shopping in Ibiza’s warehouses and the Client will be responsible for the preparation, shipping and return costs in addition to any associated handling fees.

Delivery will be considered complete from the moment the Product has been made available to the Client at the delivery address indicated, or in the Sirena or Art shopping centres

All intellectual property rights over the content of this Website, its images, texts, logos, graphic design and source codes, are owned exclusively by Shopping in Ibiza, with the exclusive exercising of the rights of use of these corresponding to Shopping in Ibiza.

Therefore, their reproduction, distribution, public communication and transformation, whether total or partial, even via a hyperlink, without the express authorisation of Shopping in Ibiza remains prohibited. Likewise, all commercial names, brands or distinctive signs of any kind of contents on this Website are protected by law.

APPLICABLE LEGISLATION AND JURISDICTION

These Terms and Conditions are governed by Spanish law.

The parties agree to submit, at their discretion, to the Courts of the Client’s address for the resolution of conflicts, expressly waiving their own jurisdiction.
